1. Scope of application

These general terms and conditions apply to all purchases and orders placed in our shop. Our General Terms and Conditions shall apply to all relevant legal relationships between us, Zander & Hampel GbR – FRECHER FÄCHER®, and the customer in the sense of §13 BGB (German Civil Code). Our products are aimed exclusively at customers who have reached the age of 18.

2. Conclusion of contract

The goods shown / presented in our online shop do not constitute a binding offer on our part. It is rather a non-binding request to order goods in our shop.

The contract between you and Zander & Hampel GbR – FRECHER FÄCHER® is concluded by clicking on the field “BUY NOW”.

After the order of the purchase offer was placed by you, you will receive an automatically generated e-mail from us, this e-mail confirms that we have received your order.

3. Costs

All stated prices are gross prices in Euro, which include the legal value added tax of currently 19 %. The prices valid on the order date shall apply. The customer has to pay the delivery costs.

4. Terms of payment

The payment of the goods of our online shop takes place exclusively by Paypal, credit card (Master/Visa), or EC card Maestro.

Should the goods not be available, the amount will be refunded or credited immediately.

5. Delivery

The delivery of our goods takes place from stock, if available from stock, to the delivery address indicated by the customer. Our delivery periods are not binding. The delivery takes place both within Germany, in EU countries and Switzerland. Our goods are carefully checked before dispatch.

The goods remain our property until full payment of the purchase price.

The customer has to pay the delivery costs. For delivery within Germany we charge the shipping price specified in the offer. For each order, shipping costs are shown and communicated separately. For delivery to another EU country or to countries outside the EU we charge a higher price. This is also shown and communicated separately. Our delivery is made via DHL.

6. Cancellation policy

According to §335 BGB, our customers may withdraw their contractual declaration within 14 days (after receipt of the goods) without giving reasons and return the goods to Zander & Hampel GbR – FRECHER FÄCHER®. However, the goods must be returned in perfect condition. This means that our goods may only be returned in cardboard boxes but not in envelopes. Repayment is made when we have received the goods back. The customer pays the costs of the return shipment.

7. Warranty

If the supplementary performance has taken place by way of a replacement delivery, the purchaser is obliged to return the goods delivered first to us within 30 days at our expense. The return of the defective goods must be carried out in accordance with the statutory provisions. We reserve the right to claim damages under the conditions regulated by law.

The contents and works on these pages created by the site operators are subject to German copyright law. The reproduction, processing, distribution and any kind of use outside the limits of copyright law require the written consent of the author or creator. Downloads and copies of these pages are only permitted for private, non-commercial use. Insofar as the content on this site was not created by the operator, the copyrights of third parties are respected. In particular, third-party content is identified as such. The contents of our pages were created with the greatest care. However, we cannot accept any liability for the correctness, completeness and topicality of the contents.

To display the fonts on our website we use web fonts from “myfonts.com”, a font service of MyFonts lnc. (“myfonts.com”), 600 Unicorn Park Drive, Woburn, MA 01801, USA. MyFonts provides licensed fonts that can be integrated into websites. For billing and license control, a so-called counting pixel/web beacon from MyFonts was deposited on our website. This allows, for example the IP address or technical data of the website visitor’s end device are transmitted to MyFonts. We do not know what data MyFonts links to the data received and for what purposes MyFonts uses this data. To prevent the execution of Java-Script code from MyFonts altogether, you can install a Java-Script blocker (e.g. www.noscript.net). 11. Liability for defects

The statutory liability for defects shall apply.

12. Final clauses

German law is applicable to contracts between Zander & Hampel GbR – FRECHER FÄCHER® and you as customer. German law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The validity of the UN sales law is excluded.

With an order the general terms and conditions of the online shop are accepted. If the customer has no general place of jurisdiction in Germany or in another EU member state, the exclusive place of jurisdiction for all disputes arising from this contract shall be our registered office.

Should any provision of these terms and conditions be or become invalid, the validity of all other provisions or agreements shall not be affected thereby.
